1. Acceptance of Terms
By accessing or using the website at www.makingawaywriting.com (the "Site"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use the Site. These terms apply to all visitors, users, and clients.
2. About Making A Way Writing Services
Making A Way Writing Services is a professional writing practice owned and operated by Rachel Arterberry, based in New Fairfield, Connecticut. We provide ghostwriting, developmental editing, book strategy, manuscript consultation, and author coaching services to coaches, consultants, executives, medical and financial professionals, nonprofit founders, and thought leaders.
3. Use of the Site
You may use this Site for lawful purposes only. You agree not to:
- Copy, reproduce, or redistribute any content from this Site without written permission
- Attempt to access any restricted areas or systems associated with this Site
- Use this Site to transmit harmful, unlawful, or offensive content
- Misrepresent your identity or affiliation when communicating with us
- Use any automated system, including bots, scrapers, or data collection tools, to access or collect data from this Site for commercial purposes without permission
- Use any content from this Site, including blog posts, sample writing, and book excerpts, to train artificial intelligence or machine learning models without written permission
4. Intellectual Property of Site Content
All content on this Site, including text, blog posts, graphics, logos, images, sample writing, and service descriptions, is the property of Making A Way Writing Services or its respective owners and is protected by applicable copyright law. Unauthorized use is strictly prohibited. Excerpts from published books appearing on this Site remain the property of their respective copyright holders.
5. Service Information and Engagement
The services described on this Site are for informational purposes and do not constitute a binding offer or contract. Pricing shown on the Site, if any, is indicative only. All client engagements are governed by a separate written agreement, proposal, or statement of work signed by both parties. Where these Terms of Service conflict with a signed client agreement, the signed client agreement controls.
6. Client Materials and Confidentiality
Ghostwriting and developmental editing require clients to share unpublished manuscripts, personal stories, proprietary frameworks, business information, and other sensitive material. We treat all client material as confidential.
We do not disclose, publish, sell, or share client manuscripts, drafts, interview recordings, or personal information with any third party, except where a client gives written permission, where a subcontractor or vendor is bound by an equivalent confidentiality obligation, or where disclosure is required by law.
Ghostwriting is, by its nature, a confidential service. We do not publicly identify a client as a ghostwriting client, use their name in marketing, or reference their project in case studies or testimonials without their written consent.
7. Ownership of Written Work
Upon full payment of all fees due under a signed client agreement, the client owns the final manuscript, including all copyright in the delivered work, unless the signed agreement states otherwise. We claim no authorship credit, royalty interest, or ongoing rights in the finished book.
Until full payment is received, all rights in draft and delivered material remain with Making A Way Writing Services. Working notes, internal outlines, research files, interview recordings, and proprietary editorial templates and processes remain our property and are not part of the deliverable unless specified in writing.
The client is responsible for securing any permissions, releases, or licenses required for third party material they supply for inclusion in their book, including quotations, images, and references to identifiable individuals.
8. Client Warranties
By engaging our services, the client represents and warrants that the material they provide is their own original work or material they have the right to use, that it does not infringe the intellectual property rights of any third party, and that it does not contain defamatory content or violate any confidentiality obligation the client owes to another party. The client agrees to indemnify Making A Way Writing Services against any claim arising from material they supplied.
9. Use of Artificial Intelligence
We are a human first writing practice. Core drafting, developmental editing, and structural work are performed by a human writer. Where AI assisted tools are used at any stage, for example research organization, transcription, or grammar review, that use is disclosed to the client and does not replace the human authorship of the manuscript.
Clients remain responsible for any AI generated material they supply to us for inclusion in their manuscript, and for making any disclosures required by their chosen publishing platform. We are happy to advise on current disclosure requirements, but that guidance is informational and not legal advice.
10. Payment, Scheduling, and Cancellation
Payment terms, deposit requirements, revision rounds, project timelines, and cancellation and refund conditions are set out in each signed client agreement. Deposits reserve a place in the project schedule and are generally non refundable, as they hold time that would otherwise be offered to another client. Specific terms for any individual engagement are governed by that engagement's written agreement.
11. Contact Form and Communications
When you submit a contact form, book a consultation, or send us an email, you consent to receive a reply from Making A Way Writing Services regarding your inquiry. We do not add you to marketing lists without your explicit consent. Information you submit is handled in accordance with our Privacy Policy.
12. Third Party Links and Services
This Site may link to third party websites or services, including scheduling tools, payment processors, retail booksellers, and social media platforms. We are not responsible for the content, availability, or privacy practices of those external services. Use of any third party service is subject to their respective terms and policies.
13. Disclaimer of Warranties
This Site and all content are provided "as is" without warranties of any kind, either express or implied. Making A Way Writing Services makes no representations about the accuracy, completeness, or suitability of the information on this Site for any purpose.
We do not guarantee any specific publishing, commercial, or professional outcome. Nothing on this Site or in any consultation should be understood as a promise that a manuscript will be accepted by an agent or publisher, achieve a particular level of sales or rankings, receive reviews or media coverage, or produce any specific business result. Publishing outcomes depend on factors outside our control.
Nothing on this Site constitutes legal, financial, tax, or medical advice.
14. Limitation of Liability
To the fullest extent permitted by law, Making A Way Writing Services shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this Site or our services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from a client engagement shall not exceed the total fees paid by the client for that engagement.
15. Governing Law
These Terms of Service are governed by the laws of the State of Connecticut, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Fairfield County, Connecticut.
16. Changes to These Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted to this page with an updated effective date. Continued use of the Site after changes are posted constitutes your acceptance of the revised terms.
